Portrait Terms &
Conditions
Each portrait session will have a signed agreement before the
photography begins. Below are the session terms &
conditions.
Terms and Conditions
1.
A Portrait Session Agreement must be signed prior to any
photography commencing.
2.
Guarantee – 100% money paid is refunded if you see no
images you like at the show session. Conditional upon –
Portrait session must have occurred; show session taken
place within 4 weeks of Portrait session; no images are
chosen or supplied from or after the show session; images
are not shown via email or an on-line gallery; no images
were taken during the portrait session by anyone other than
the Affinity Photography photographer; no gift prints or any
other products is supplied and all credit is forfeited; only
money actually paid to Affinity Photography is refunded;
3.
Booking fee – a booking fee is required to secure the time
and date of your portrait session. This is credited towards
the session fee due for the session (which must be paid
prior to the session taking place)
4.
Session fee– a session fee is required for your portrait
session. It does not cover Travel charges, postage, prop
fees, venue fees and any other additional expenses
occurred as a result of your portrait session. The session fee
will become credit to be used towards purchases at your
complimentary show session, if not forfeited. The session
fee is forfeited if the client reschedules the portrait session
booking or show session booking less than 3 days before
the scheduled time and date without prior agreement with
Affinity Photography; cancels the session less than 7 days
before the schedule time and date; or turns up 30 minutes
past the scheduled time and date for either their portrait
session or show session;
5.
Credit – Credit from your session fee, Gift Certificate, Gift
Voucher, or promotion, (except for Corporate sessions,
Christening packages and Cake Smash sessions) can be
used towards purchase of your images and products and
must be used during your complimentary show session. Any
and all credit may be forfeited if anyone other than the
Affinity Photography photographer takes images during the
portrait session. It does not cover Travel charges, postage,
prop fees, venue fees and any other additional expenses
occurred as a result of your portrait session.
6.
Payment - Full payment of the Session fee must be made
before any photography begins. Should you cancel the
booking date or request a refund more than 7 days before
the scheduled time and date of the portrait session, monies
paid by you to Affinity Photography will be returned. Should
you cancel the booking date or request a refund less than 7
days before the scheduled time and date of the portrait
session a $50 cancellation fee is charged; Only one Gift
Certificate, discount or offer can be used per session;
money actually paid to Affinity Photography for your session
fee is considered ‘session fee credit’ (see number 4)
7.
Travel charges may apply for distances further than 20km
from Bentleigh, Victoria at the rate of $1 per km.
8.
Any portrait offer value is not redeemable for cash in whole
or part;
9.
Should the photographer need to cancel or reschedule the
Portrait Session, you will be offered a refund of monies
actually paid to Affinity Photography for this session if an
alternative booking is not desired by you;
10.
You acknowledge that the booking of and payment for any
venue fees, props and the like, used for your photography
session will be your responsibility;
11.
Product orders, prints and reprints will be at current
studio prices at the time of ordering; Collection of any
ordered products is from the Bentleigh studio. Postage of
products will incur an additional charge and any credit
cannot be used for postage.
12.
Show session – is a 90 minute appointment to view the
images on-screen and to choose images and products at
the Bentleigh Studio for purchase. One show session is
complimentary as part of the Portrait Session (except
Corporate Portrait Sessions) and must be taken within 4
weeks from the portrait session. Any and all included
Credit (see number 5) must be used during your
complimentary show session otherwise will be forfeited.
Should the client cancel or reschedule this session less than
3 days prior to, or non-arrival 30 minutes past the show
session time, the complimentary show session is considered
as having taken place. Further show sessions will attract a
fee of $45 per show session;
13.
Limitation of liability. Extreme professional care and
diligence will be exercised in the performance of this
booking. No warranty is expressed or implied and no
guarantee is given for delivery of any specially requested
images; Affinity Photography and/or the photographer’s
entire liability for any claim, loss, damage or injury arising
from or relating to this agreement and performance of this
booking is limited to monies paid to Affinity Photography for
this booking. In no event shall Affinity Photography and/or
the photographer be liable for special, incidental,
consequential or punitive damages in relation to this
booking; Should mechanical failure, theft, accident or other
mishap beyond reasonable control prevent the fulfilment of
the assignment by Kaye Wright and/or Affinity Photography,
liability will be limited to refund of monies paid to Affinity
Photography for this session;
14.
Copyright and ownership of the photographic images
remain the property of Kaye Wright and may not be
reproduced, sold or used for commercial purposes in
any form without written permission from the copyright
holder; Reproduction of purchased digital images are
allowed by the client for personal purposes only.
15.
You acknowledge the digital images will be kept for 3
months from time of the portrait session, after which time
they may be destroyed without further notice;
16.
You understand that should Kaye Wright as the
photographer not be available for any reason, Kaye Wright
may provide another photographer and notify you of the
change;
17.
The professional service of Kaye Wright is obtained with the
unconditional understanding that she or the nominated
photographer (as per number 16) will be the only and
exclusive photographer. No other photographs can be taken
during the session;
18.
You understand and consent that any of the images
taken during this session may be used for advertising,
display, editorial, competition, and/or exhibition
purposes for Kaye Wright and/or Affinity Photography.

Gift Certificate Additional Terms &
Conditions
1. You must book and have your portrait session before the expiry
or ‘valid until’ date.
2. A $50 booking fee is required to secure your date and time.
This can be used as credit towards your purchases or refunded if
you only use your Gift Certificate credit which must be done at
your complimentary show session;
3. You must book and have your complimentary show session
within 4 weeks of your portrait session otherwise remaining gift
certificate credit and booking fee credit is void;
4. All credit must be used at your complimentary show session.
5. THREE days notice is required by email if your session time is
no longer suitable, otherwise your gift certificate is deemed invalid.
6. No gift certificate value can be redeemed for cash.
7. Normal portrait Terms & Conditions apply upon booking
8. Your Gift Certificate can be used for image purchases from a
Family, Pregnancy, Baby&Toddler, or Newborn portrait session
9. Only one Gift Certificate can be used for portrait sessions per
family per year
10. Only one Gift Certificate can be used per portrait session.
