Terms & Conditions
Each Affinity Photography session will have a signed agreement before the photography begins.  Terms & Conditions are shown in the booking system before you book in your session and must be accepted at that time.  ** Below are the same Ts&Cs you’ll find when you book on-line Prior to your session, a hardcopy with the same Terms & Conditions must be signed.  Terms and Conditions 1.   A Portrait Session Agreement must be signed prior to any photography commencing.  2.   Guarantee – 100% money paid is refunded if you see no images you like at the show session. Conditional upon – Your portrait session must take place; A refund must be request within 4 weeks of your portrait session; No images are chosen, ordered, or supplied from your portrait session; If any images were displayed via the on-line gallery, these have not been copied, downloaded, edited or used in any way; No images were taken at the portrait session by anyone other than the Affinity Photography photographer; No gift prints or any other product is supplied and all credit is forfeited; Images will not be available for future viewing and choosing; Only money actually paid to Affinity Photography is refunded 3.   Booking fee – a $100 booking fee is required to secure the time and date of your portrait session. This is credited towards the chosen package for the time and day booked.  The booking fee is forfeited if the client doesn’t show up for the booked time and day without prior agreement with Kaye from Affinity Photography.  The booking fee is forfeited if the client reschedules the booked time and day less than 2 days before the time without prior agreement with Kaye from Affinity Photography. 4.   Cancellations - Should you cancel the booking date or request a refund more than 7 days before the scheduled time and date of the portrait session, monies paid by you to Affinity Photography will be returned.Should you cancel the booking date or request a refund 7 days or less before the scheduled time and date of the portrait session a $50 cancellation fee is charged;  A purchased Gift Voucher can be cancelled with a full refund 2 weeks after purchase if not used in full or part.  A purchased Gift Voucher is not refunded if more than 2 weeks has passed since the purchase. 5.  Payment -  A booked fee must be made to secure the time and date of your portrait session.  Full payment of the Package fee must be made before any images are provided.  The package fee does not cover Travel charges, postage, prop fees, venue fees and any other additional expenses occurred as a result of your portrait session. The package fee includes only the items listed upon booking.   Only monies paid to Affinity Photography can be refunded.  6.  Travel charges may apply for distances further than 20km from Bentleigh, Victoria at the rate of $1 per km.  7.  Should the photographer need to cancel or reschedule the Portrait Session, you will be offered a refund of monies actually paid to Affinity Photography for this session if an alternative booking is not desired by you; 8.   You acknowledge that the booking of and payment for any venue fees, props and the like, used for your photography session will be your responsibility; 9.   Product orders for Frames, Canvas, Boxed Canvas and Matted Prints will be at current studio prices at the time of ordering; Collection of any ordered products is from the Bentleigh studio.  Postage of products will incur an additional charge 10. On-line Gallery – your images will be available to view in your on-line passworded galery 4 days after your session, 2 days after a corporate session, 3 weeks after a wedding;  Your gallery is complimentary for 4 weeks for a family, pregnancy, wedding, or baby package, and 1 week for a corporate package.  Further gallery time is charged at $15 per month or part.   11.  Limitation of liability. Extreme professional care and diligence will be exercised in the performance of this booking.  No guarantee is expressed or implied and no guarantee is given for delivery of any specially requested images; Affinity Photography and/or the photographer’s entire liability for any claim, loss, damage or injury arising from or relating to this agreement and performance of this booking is limited to monies paid to Affinity Photography for this booking. In no event shall Affinity Photography and/or the photographer be liable for special, incidental, consequential or punitive damages in relation to this booking; Should mechanical failure, theft, accident or other mishap beyond reasonable control prevent the fulfilment of the assignment by Kaye Wright and/or Affinity Photography, liability will be limited to refund of monies paid to Affinity Photography for this session; 12.  Copyright and ownership of the photographic images remain the property of Kaye Wright and may not be reproduced, sold or used for commercial purposes in any form without written permission from the copyright holder; Reproduction of purchased digital images are allowed by the client for personal purposes only. 13.  You acknowledge the digital images will be kept for 3 months from time of the portrait session, after which time they may be destroyed without further notice; 14.  You understand that should Kaye Wright as the photographer not be available for any reason, Kaye Wright may provide another photographer and notify you of the change; 15.  The professional service of Kaye Wright is obtained with the unconditional understanding that she or the nominated photographer (as per number 14) will be the only and exclusive photographer. No other photographs can be taken during the session; 16.  You understand and consent that any of the images taken during this session may be used for advertising, display, editorial, competition, and/or exhibition purposes for Kaye Wright and/or Affinity Photography.
